Terms and Conditions of Use
Introduction
By registering for the Cross-Border Health Services of the National eHealth Authority (NeHA), hereinafter referred to as "the Portal", you agree to abide by the Terms and Conditions set forth in this document. Understanding and complying with the Terms and Conditions is your sole responsibility.
Make sure you understand your responsibilities and what constitutes misuse of the Portal.
Additionally, this document provides useful guidance regarding measures you can take to ensure that your computer, the software installed on it, and the personal data stored are not compromised. Your registration on the Portal automatically implies your consent and acceptance of responsibility for implementing the instructions contained in this document.

Specifically
The Portal is divided into two areas. The first area concerns the Beneficiaries' Portal, to which secure access is provided to the Beneficiaries of Cross-Border Health Services, hereinafter referred to as "Beneficiary (-ies)", and the second area relates to the Providers' Portal. In this area, secure access is provided to all healthcare professionals who are registered with the Cyprus Medical Association (CMA) or the Pharmacy Council (PC), hereinafter "Provider (-s)".
By activating your registration on the Portal via GOV.CY (https://www.gov.cy/), you automatically become an account holder with access to the Portal. You can register as a Beneficiary and gain access to the Beneficiaries' Portal area. With the same account, if you are a Provider, you can simultaneously register under that capacity and also gain access to the Providers' Portal area. As a Beneficiary, you can submit a registration application on the Portal via GOV.CY for yourself as well as for other persons (children, dependents, other relatives, etc.).

These Terms and Conditions apply to Providers who have access to the Portal to process information related to Cross-Border health services, within the framework of healthcare provision provided by the NeHA.
If you wish, you can terminate your use of the Portal at any time by submitting a request to the NeHA at info@neha.org.cy. However, please note that if you are a Provider, using the Portal to perform tasks related to Cross-Border health services is a legal obligation (Article 19-(1) of the Electronic Health Law of 2019 (59(I)/2019)).
Minimum technical requirements for using the Portal
You can access the Portal at any time through your own electronic devices, provided that these devices use the latest version of a web browser (such as Google Chrome, Firefox, Microsoft Internet Explorer or Edge, or Safari) and a document reader application (PDF). You will also need an internet connection and a valid/active email address. Certain features may require printing capabilities. Additionally, you must have a mobile phone capable of receiving SMS messages on a mobile number issued by a telecommunications service provider in Cyprus. You are solely responsible for maintaining the security of your devices and all applications installed on them, including updating them to the latest versions and/or upgrades, as well as required security patches provided by third parties.
Functions of the Portal
The Portal allows you as a Beneficiary to:
Read or download your medical data in PDF format.
Get informed about cross-border health services.
Search for information regarding the National Contact Points of European countries supporting cross-border health services.
Furthermore, if you register and use the Providers' section of the Portal, depending on your role and field (doctor, pharmacist), the Portal allows you to:
Access cross-border health services.
Create the medical history of the beneficiary.
Read the medical history of a European citizen visiting Cyprus.
Dispense the electronic prescription of a European citizen visiting Cyprus.
Your responsibilities when using the Portal
The Portal is subject to strict rules regarding personal data protection and information security, which are closely monitored. However, protecting your data is also your responsibility. To this end, you should always read carefully, understand your relevant responsibilities, and apply at least the following guidelines.
DO NOT SHARE YOUR USERNAME AND PASSWORD WITH ANYONE.
If you share your username and password with someone else, you will compromise the security of the Portal.
Restrictions when using the Portal
By accessing the Portal, you agree that under no circumstances will you:
use the Portal for any unlawful purpose or to promote illegal activity;
attempt to interfere in any way with the proper operation of the Portal and the IT system of cross-border health services;
attempt to use the Portal to gain unauthorized access to any other IT system, computer, or account of another user of the Portal;
bypass or attempt to bypass any measures we take to restrict access to the Portal, or use any software, technology, or device to acquire and/or interfere with information and data within the Portal, alter them, intercept them, or process them in any unauthorized manner;
use another user's account without their permission;
If the NeHA determines that you have violated any of the above restrictions or any other rule included in these Terms and Conditions and/or have in any other way abused your user account on the Portal, the NeHA reserves the right, at its sole discretion, to suspend your access to the Portal. In such a case, you will receive a relevant notification.
Intellectual property
The Portal contains content protected by copyright law, including, among other things, text, photographs, graphics, icon buttons, images, artwork, names, logos, trademarks, service marks, and data ("Content"). Except as permitted under these Terms and Conditions, you agree not to sell, license, copy, reproduce, modify, transmit, edit, adapt, create derivative works from, distribute, or otherwise use the Content in whole or in part without the express written consent of the NeHA.
You agree not to perform reverse engineering, decompile, disassemble, or attempt to extract or discover the source code of the IT system of cross-border health services or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law despite this restriction.
Intellectual property
As a Provider, you will use the Portal to deliver the services you offer within the framework of cross-border health services.
Consequently, for the implementation of European and Cypriot data protection legislation, you as a Provider will act as a data controller for the personal data you process through the Portal.
This means that, to the extent you use the Portal as a Provider, it will be your responsibility to comply with all applicable provisions of European and Cypriot law regarding data protection, particularly the European Union General Data Protection Regulation (GDPR) and the Protection of Natural Persons with regard to the Processing of Personal Data and for the Free Movement of Such Data Law of 2018 (L.125(I)/2018 of the Republic of Cyprus).
This also means that if you use the Portal as a Provider, it will be your responsibility to comply with all other legislative and contractual rules that apply to you as a Provider offering healthcare services in the areas controlled by the Republic of Cyprus.
Intellectual property
The legal relationships between the NeHA and the users of the Portal are governed exclusively by the laws of the Republic of Cyprus, unless rules of international private law apply. Any dispute shall be resolved exclusively in the competent court according to the laws of the Republic of Cyprus.
